2.8 University Terms & Conditions

The University of Texas System clearly identifies Terms & Conditions that apply to solicitations, purchase orders and contracts:

Solicitations:

  • Bidders responding to an Invitation to Bid (ITB) must agree to the Terms & Conditions listed in the ITB document.
  • For other types of solicitations, such as Requests for Proposal (RFP), a section on terms and conditions is included as part of the solicitation document.  Any exceptions identified by proposers must provide alternate language and may be grounds for disqualification.

Purchase Orders:

  • The purchase order document contains a link to the Terms & Conditions that govern the transaction.

Contracts:

  • Contracts entered into between the University and a supplier contains all Terms & Conditions that have been mutually agreed by both parties.  Any changes to the Terms & Conditions must be formalized by an addendum to the contract.
